Terms of Use for Flightbook.at
Effective: February 2025
1. General Provisions
- These Terms of Use govern the relationship between users and the operator of the Flightbook.at platform (hereinafter referred to as "Platform").
- By registering and using the Platform, the user agrees to these terms.
- The Platform is intended exclusively for adults or minors using it with the consent of a legal guardian.
- Austrian law shall apply exclusively, taking into account relevant EU regulations (such as GDPR, DSG, E-Commerce Act) and other relevant legal provisions (e.g., Media Act, Consumer Protection Act).
- The operator reserves the right to discontinue or terminate the service, in whole or in part, at any time. There is no entitlement to uninterrupted availability of the platform or to data backup and recovery. Any liability of the operator for data loss, disruptions, or other operational interruptions is expressly excluded.
2. Flightbook.at Registration (Light and General Functions)
2.1 Registration and User Account
- Registration is required to use the Platform. At a minimum, the following information must be provided: full name, valid email address, and – depending on the function – postal address and other master data (e.g., official registration numbers, if required).
- The user undertakes to provide truthful, complete, and always current information.
- Access data must be treated as strictly confidential and must not be passed on to third parties.
- In case of misuse or violation of these Terms of Use, the operator reserves the right to block or delete the user account without prior notice.
2.2 Club Memberships, Photo Blogs, and Event Registrations
- Club Memberships: Users can manage their memberships in model aircraft clubs via the platform. When joining a club, the relevant master data is either transmitted directly to the club or made available to the club.
- Photo Blogs and Content: Users can upload photos and create photo blogs. By uploading, the user grants the operator a non-exclusive, royalty-free right to display this content on the platform. The user warrants that they have the necessary rights to the uploaded content and that no third-party rights are infringed.
- Event Registrations: Clubs can announce events via the platform. When registering for an event, the necessary master data is transmitted to the respective organizer. The operator assumes no liability for the process and execution of the events.
3. Flightbook.at Premium Membership
The use of the paid Premium access is subject to the following regulations in addition to the general provisions:
3.1 Registration and Scope of Services
- Separate registration is required for Premium access. In addition to the general master data, the current postal address and valid payment information must be provided.
- Upon conclusion of the paid subscription, the user receives a limited, non-exclusive, and non-transferable right to use the Premium area of the platform.
3.2 Subscription and Payment Terms
- Term and Automatic Renewal: The Premium subscription has a term of one month and renews automatically. The user has the option to cancel the automatic renewal. If no cancellation is made, the subscription continues from the beginning of the next billing period.

Cancellation:
- Cancellation of the Premium subscription can be done at any time via the designated function in the user interface.
- The cancellation becomes effective at the end of the current billing period.
- There is no pro-rata refund of the subscription fee already paid.

Fee Change:
- The operator reserves the right to change the subscription fees at any time.
- The user will be informed about a change in fees via (unencrypted) email.
- If the fees are changed, the new fee applies from the next billing period, unless the user cancels via the user interface or cancels the automatic renewal.
3.3 Payment Processing
- Payment processing is handled exclusively by the payment service provider Stripe.
- By subscribing, the user agrees that the necessary payment information will be transmitted to Stripe.
- Stripe operates in accordance with the provisions of the European Payment Services Directive (PSD2) and is committed to maintaining appropriate security measures.
- Transaction fees and all tax obligations related to the use of Stripe are borne by the user. Further information can be found in Stripe's terms and conditions.
4. Data Protection and Cookies
4.1 Data Protection
- The operator processes personal data exclusively on the basis of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG) as well as other applicable data protection regulations.
- Data processing is carried out to provide the platform and to fulfill legal obligations.
- Detailed information on data processing is available in the separate Privacy Policy.
4.2 Cookies
- Use of Cookies: The Platform uses cookies, which are small text files stored on the user's device. Cookies serve to facilitate the visit and use of the Platform, improve user-friendliness, and collect statistical data for optimizing the Platform.

Types of Cookies:
- Technically Necessary Cookies: These cookies are required to ensure basic functions of the platform (such as authentication, navigation, or security). Without these cookies, the use of the platform would not be possible or would be limited.
- Analytics and Functional Cookies: These cookies allow analysis of user behavior, storage of preferences, and thus improvement of the service. Aggregated and anonymized data is collected, which does not allow any conclusions to be drawn about the identity of individual users.
- Purpose of Cookie Use: Cookies are used to optimize the platform, analyze user behavior, and personalize the user experience.
- Consent and Revocation: By using the Platform, the user automatically agrees to the use of cookies. The user can revoke their consent to the use of cookies at any time by selecting the appropriate function in their web browser settings. However, it should be noted that in this case, individual functions of the Platform may be restricted or no longer fully available.
- Data Transfer to Third Parties: Where technically necessary or intended for analysis purposes, third-party cookies may also be placed on the user's device. Continued use of the platform is also considered consent to the use of these cookies.
5. Availability, Disclaimer of Liability, and Other Provisions
5.1 Availability and Service
- The operator strives to provide the platform continuously and in technically sound condition. However, no guarantee is given for uninterrupted, error-free, or secure availability.
- The operator reserves the right to discontinue or terminate the service – in whole or in part – at any time without prior notice.
5.2 Disclaimer of Liability
- The operator assumes no liability for damages arising from the use or inability to use the platform, unless based on gross negligence or intent.
- In particular, no liability is assumed for indirect damages, consequential damages, or data loss.
6. Changes to the Terms of Use and Communication
6.1 Changes
- The operator reserves the right to change these Terms of Use at any time.
- Material changes will be communicated to the user via email (in unencrypted form).
- Changes to the terms – especially subscription fees – become effective from the next billing period, unless the user cancels in time (via the user interface) or cancels the automatic renewal.
6.2 Communication
- By using the Platform, the user agrees that all communications (e.g., regarding changes to the terms) may also be made via unencrypted email.
7. Final Provisions
- Should individual provisions of these Terms of Use be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
- The place of jurisdiction for all disputes arising from or in connection with these Terms of Use is Vienna.
- Austrian law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
By registering for or using the platform, the user accepts these Terms of Use in full.
