Terms of Use for Flightbook.at

1. General Provisions

  1. These Terms of Use govern the relationship between users and the operator of the Flightbook.at platform (hereinafter referred to as "Platform").
  2. By registering and using the Platform, the user agrees to these terms.
  3. The Platform is intended exclusively for adults or minors using it with the consent of a legal guardian.
  4. Austrian law shall apply exclusively, taking into account relevant EU regulations (such as GDPR, DSG, E-Commerce Act) and other relevant legal provisions (e.g., Media Act, Consumer Protection Act).
  5. The operator reserves the right to discontinue or terminate the service, in whole or in part, at any time. There is no entitlement to uninterrupted availability of the platform or to data backup and recovery. Any liability of the operator for data loss, disruptions, or other operational interruptions is expressly excluded.

2. Flightbook.at Registration (Light and General Functions)

2.1 Registration and User Account

  1. Registration is required to use the Platform. At a minimum, the following information must be provided: full name, valid email address, and – depending on the function – postal address and other master data (e.g., official registration numbers, if required).
  2. The user undertakes to provide truthful, complete, and always current information.
  3. Access data must be treated as strictly confidential and must not be passed on to third parties.
  4. In case of misuse or violation of these Terms of Use, the operator reserves the right to block or delete the user account without prior notice.

2.2 Club Memberships, Photo Blogs, and Event Registrations

  1. Club Memberships: Users can manage their memberships in model aircraft clubs via the platform. When joining a club, the relevant master data is either transmitted directly to the club or made available to the club.
  2. Photo Blogs and Content: Users can upload photos and create photo blogs. By uploading, the user grants the operator a non-exclusive, royalty-free right to display this content on the platform. The user warrants that they have the necessary rights to the uploaded content and that no third-party rights are infringed.
  3. Event Registrations: Clubs can announce events via the platform. When registering for an event, the necessary master data is transmitted to the respective organizer. The operator assumes no liability for the process and execution of the events.

3. Flightbook.at Premium Membership

The use of the paid Premium access is subject to the following regulations in addition to the general provisions:

3.1 Registration and Scope of Services

  1. Separate registration is required for Premium access. In addition to the general master data, the current postal address and valid payment information must be provided.
  2. Upon conclusion of the paid subscription, the user receives a limited, non-exclusive, and non-transferable right to use the Premium area of the platform.

3.2 Subscription and Payment Terms

  1. Term and Automatic Renewal: The Premium subscription has a term of one month and renews automatically. The user has the option to cancel the automatic renewal. If no cancellation is made, the subscription continues from the beginning of the next billing period.
  2. Cancellation:
    1. Cancellation of the Premium subscription can be done at any time via the designated function in the user interface.
    2. The cancellation becomes effective at the end of the current billing period.
    3. There is no pro-rata refund of the subscription fee already paid.
  3. Fee Change:
    1. The operator reserves the right to change the subscription fees at any time.
    2. The user will be informed about a change in fees via (unencrypted) email.
    3. If the fees are changed, the new fee applies from the next billing period, unless the user cancels via the user interface or cancels the automatic renewal.

3.3 Payment Processing

  1. Payment processing is handled exclusively by the payment service provider Stripe.
  2. By subscribing, the user agrees that the necessary payment information will be transmitted to Stripe.
  3. Stripe operates in accordance with the provisions of the European Payment Services Directive (PSD2) and is committed to maintaining appropriate security measures.
  4. Transaction fees and all tax obligations related to the use of Stripe are borne by the user. Further information can be found in Stripe's terms and conditions.

4. Data Protection and Cookies

4.1 Data Protection

  1. The operator processes personal data exclusively on the basis of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG) as well as other applicable data protection regulations.
  2. Data processing is carried out to provide the platform and to fulfill legal obligations.
  3. Detailed information on data processing is available in the separate Privacy Policy.

4.2 Cookies

  1. Use of Cookies: The Platform uses cookies, which are small text files stored on the user's device. Cookies serve to facilitate the visit and use of the Platform, improve user-friendliness, and collect statistical data for optimizing the Platform.
  2. Types of Cookies:
    • Technically Necessary Cookies: These cookies are required to ensure basic functions of the platform (such as authentication, navigation, or security). Without these cookies, the use of the platform would not be possible or would be limited.
    • Analytics and Functional Cookies: These cookies allow analysis of user behavior, storage of preferences, and thus improvement of the service. Aggregated and anonymized data is collected, which does not allow any conclusions to be drawn about the identity of individual users.
  3. Purpose of Cookie Use: Cookies are used to optimize the platform, analyze user behavior, and personalize the user experience.
  4. Consent and Revocation: By using the Platform, the user automatically agrees to the use of cookies. The user can revoke their consent to the use of cookies at any time by selecting the appropriate function in their web browser settings. However, it should be noted that in this case, individual functions of the Platform may be restricted or no longer fully available.
  5. Data Transfer to Third Parties: Where technically necessary or intended for analysis purposes, third-party cookies may also be placed on the user's device. Continued use of the platform is also considered consent to the use of these cookies.

5. Availability, Disclaimer of Liability, and Other Provisions

5.1 Availability and Service

  1. The operator strives to provide the platform continuously and in technically sound condition. However, no guarantee is given for uninterrupted, error-free, or secure availability.
  2. The operator reserves the right to discontinue or terminate the service – in whole or in part – at any time without prior notice.

5.2 Disclaimer of Liability

  1. The operator assumes no liability for damages arising from the use or inability to use the platform, unless based on gross negligence or intent.
  2. In particular, no liability is assumed for indirect damages, consequential damages, or data loss.

6. Changes to the Terms of Use and Communication

6.1 Changes

  1. The operator reserves the right to change these Terms of Use at any time.
  2. Material changes will be communicated to the user via email (in unencrypted form).
  3. Changes to the terms – especially subscription fees – become effective from the next billing period, unless the user cancels in time (via the user interface) or cancels the automatic renewal.

6.2 Communication

  1. By using the Platform, the user agrees that all communications (e.g., regarding changes to the terms) may also be made via unencrypted email.

7. Marketplace

Under the name "Marketplace", Flightbook.at offers its users the possibility to list used model aircraft and model-flight-related accessories for sale and to get in touch with prospective buyers. In addition to the general provisions, the following rules apply to the use of the Marketplace.

7.1 Role of the Operator

  1. With the Marketplace, the operator solely provides the technical infrastructure through which users can publish listings, browse offers and contact each other. The operator itself does not offer any items, does not broker any transactions and at no time becomes a party to a contract concluded between users. Purchase contracts are concluded exclusively and directly between the respective seller and buyer.
  2. The entire handling of a purchase – in particular the agreement on the purchase price, payment, handover or shipping of the item, warranty matters and any reversal of the transaction – takes place exclusively between the contracting parties and is their sole responsibility. The operator assumes no warranty or liability whatsoever for the conclusion or proper fulfilment of such contracts, for the identity, reliability or creditworthiness of users, or for the accuracy and completeness of the information provided in listings. Users are advised to exercise the diligence customary in online trading when handling transactions.

7.2 Listings and Seller Obligations

  1. The Marketplace serves the private sale and purchase of items related to model flying, in particular model aircraft, radio transmitters, batteries, drive components and other accessories. Posting offers without a connection to model flying is not permitted. Anyone wishing to offer items in the course of a commercial activity requires the prior express consent of the operator.
  2. The seller undertakes to provide truthful, complete and non-misleading information in their listings. The photos used must show the item actually offered in its current condition. If a model is sold without individual components (for instance without the transmitter or without batteries), this must be made clearly recognisable in the listing; the platform provides a dedicated feature ("scope of delivery") for this purpose.
  3. Only items whose sale and possession is permitted under the applicable statutory provisions may be offered. The respective seller bears sole responsibility for the legality of an offer, including compliance with product and aviation regulations.
  4. The operator is entitled to edit, deactivate or delete, without prior notice, listings that violate these terms of use or applicable law, or where there is a reasonable suspicion of such a violation. In the event of repeated or serious violations, the operator may temporarily or permanently exclude individual users from using the Marketplace; the provisions on account suspension in Section 2 remain unaffected.

7.3 Verified Flight Data and AI Features

  1. Listings created from a user's digital hangar may carry the label "Flightbook-verified". This label solely expresses that the displayed flight data – such as the number of flights, the total flight time or the date of the first flight – has been taken unchanged from the seller's logbook kept on the platform. It constitutes neither an inspection of the item by the operator nor any assurance or guarantee regarding its condition, its properties or its freedom from defects.
  2. The platform offers sellers AI-powered assistance features, for example for creating description texts or estimating a typical market price. Such content is generated automatically and constitutes non-binding suggestions; in particular, it is neither an advisory service nor a binding valuation. The user is obliged to review AI-generated content for accuracy before publication and to adjust it where necessary. The operator assumes no liability for the substantive accuracy of AI-generated suggestions. The operator is entitled to limit the scope of the AI features (for example through daily quotas), to change them or to discontinue them entirely.

7.4 Communication via the Marketplace

  1. For contact between prospective buyers and sellers, the platform provides an internal messaging feature. It serves exclusively for initiating and handling purchases via the Marketplace. Using the messaging feature for advertising, bulk messages (spam), harassment or the dissemination of unlawful content is prohibited.
  2. In the event of concrete indications of misuse of the messaging feature or the Marketplace, the operator reserves the right to take appropriate measures. These include in particular the removal of individual content, the restriction of the messaging feature and the temporary or permanent suspension of the user account concerned.

8. Final Provisions

  1. Should individual provisions of these Terms of Use be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
  2. The place of jurisdiction for all disputes arising from or in connection with these Terms of Use is Vienna.
  3. Austrian law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.

By registering for or using the platform, the user accepts these Terms of Use in full.
